Gamini Senarath’s appeal challenging Commercial HC order fixed for March 26

The Supreme Court yesterday fixed for March 26, an appeal petition filed by Gamini Senarath challenging Colombo Commercial High Court’s decision to accept an ammended petition filed by the Sri Lanka Transport Board (SLTB).

The SLTB had filed a lawsuit in the Commercial High Court in connection with defaulting a sum of Rs.142 million owed to the SLTB, whose buses were used to transport people to election rallies of former President during the 2015-Presidential Election campaign. Three-judge-bench Bench comprising Justice Vijith Malalgoda, Justice Murdu Fernando and Justice Gamini Amarasekara differed the matter for March 26 since Justice Amarasekara declined to sit on the Bench.

Through an amended petition, the plaintiff SLTB had decided to exclude Minister Susil Premajayantha and Minister Anura Priyadarshana Yapa from the defendant list.

According to the ammended plaint SLTB has named five UPFA 20015-presidential election committee members, including former President Mahinda Rajapaksa, United Peoples Freedom Alliance (UPFA), Sri Lanka Freedom Party (SLFP), election committee members Gamini Senarath and Amal Senadhilankara as respondents.

The SLTB had earlier named seven parties including former SLFP General Secretary Anura Priyadarshana Yapa and UPFA General Secretary Susil Premajayantha as defendants.

The SLTB said the UPFA had hired buses from the SLTB for the January 8, 2015 Presidential Election rallies but had failed to settle the payments after obtaining the services.
