The Supreme Court will deliver its verdict on Friday on the issue of providing reservation in promotions to Scheduled Castes (SC) and Scheduled Tribes (ST) in government jobs.
The top court had reserved its verdict on October 26, 2021. The Center had earlier told the bench that it is a fact of life that even after nearly 75 years, the people of SC and ST have not been brought to the same level of competency as the forward castes.
Justice L. A three-judge bench headed by Nageswara Rao heard all the parties in the matter including Attorney General KK Venugopal, Additional Solicitor General (ASG) Balbir Singh and other senior lawyers appearing for different states. It is true that even in the 75 years of the country’s independence, the people of SC/ST community have not been brought to the level of intelligence equal to that of the forward classes.
Venugopal had argued that it is more difficult for people belonging to the SC and ST communities to get a higher post in Group ‘A’ category jobs. Now the time has come that the Apex Court should give some concrete basis for SC, ST and OBC (Other Backward Classes) to fill the vacancies.
The bench had earlier said that it would not reopen its decision on the issue of granting reservation in SC/ST promotions and said it was for the states to decide how they were going to implement it.
During the hearing, in the matter of reservation in promotion, the Supreme Court had sought data from the central government, showing that the decision to continue with the reservation in promotion was based on quantitative data about the adequacy of representation.
The court had asked many questions like why this system was kept pending in government jobs for so many days, what are the figures regarding this etc. The petitioner referred to the Indira Sawhney case before the court.
His argument was that even after that decision, the system of reservation in promotion for scheduled castes and tribes has not been done smoothly till now.
